Employee branded ‘immature’ after complaining of sexual harassment wins £15,000
Experts described this case as ‘clear-cut sex discrimination’
What systems are in place in your workplace to prevent or deal with vicarious liability and sexual harassment?

A bathroom supplies company has been ordered to pay more than £15,000 by Watford Employment Tribunal, after its director called an employee “immature” and fired her for alleging sexual harassment. Click here to read the article.
The employee was subjected to sex discrimination by her boss and the owner of the business, regularly subjecting her to sexual comments and touching on multiple occasions. His behaviour made her feel stressed about being alone with him at work and she felt powerless because he was her boss.
The tribunal heard she had been subjected to abusive language and derogatory comments about her age and religion from other colleagues and treated with inequality. After an unsuccessful informal investigation, a formal grievance was lodged primarily about her co-worker’s behaviour which was also ignored.
She was dismissed from the company and slated as immature. Signed off work with stress and anxiety for weeks following the dismissal, she recounted at the tribunal how her stress levels had made her physically ill.
Employers have to be aware that the vicarious liability provisions in the law open them up to very large injury-to-feelings awards, even when they are not aware that the discriminatory action is taking place.
Ordered to pay £10,000 for injury to feelings, with an additional 12.5 per cent for failing to comply with the ACAS code and respond to the claim, brought the total of the award to £11,250. The company was asked to pay more than £15,000 in total, with other elements including notice pay, holiday pay and loss of earnings.

The Nyland family cycle to their father’s hometown to raise funds for potentially lifesaving cancer treatment for a work colleague.


On Thursday 19th July 2018, five members of the same family Sean, William, Lloyd, Michael and Gabrielle set off from Delden Cranes ltd, at Selston, to cycle 240 miles over 3 days, all the way to the pretty little town in the Netherlands, called Delden!! This is where their father Willie Nyland was born and where the company name originates.
Following a team talk and lots of photographs the team set off at 07.10.am. The journey took the family through Nottinghamshire, Yorkshire and Humberside, over the Humber bridge before they reached Hull at 18.06pm to catch the ferry to Rotterdam.
Friday morning, they arrived at Rotterdam and disembarked the ferry at 07.53.am.
The first stop in Holland was 10.23a.m at the historic Kinderdijke, where Dutch apple cake and coffee was the order of the day!! 11.00a.m. the journey continued through many beautiful Dutch towns, Streefkerk, Groot-Ammers and Lopik, where they crossed the river on a ferry. At 13.50 p.m. they arrived at Lopikerkapel, and stopped for lunch!!
The team, having cycled 100 miles in very hot temperatures, reached Otterlo at 17.18p.m where they spent the night for a much-needed cool down, rest and a few beers.
The final day Saturday 21st July at 08.47am the team mounted their bicycles for the last leg of the journey. The team travelled through Hoenderloo and stopped at Zutphen for a coffee break. The team, at this point looking very professional, managed to race along through Lochem, Markelo and Hof Van Twente, finally arriving in Delden at 13.07p.m to some very welcome cold beers all around.
