A skip hire and waste management company and its Managing Director have been sentenced after a worker was seriously injured.
An employee was crossing the yard while waiting for his Artic lorry to be re-loaded with waste. He was hit by a 21 tonne loading shovel as he was crossing. The vehicle was reversing around a blind bend in the yard. The employee suffered life changing injuries, and he is still recovering. He has also been unable to return to work since the incident in 2018.
The Health & Safety Executive conducted an investigation. They found that there was no adequate pedestrian segregation in the yard. This would have meant that pedestrians and vehicles could move around safely.
Director of the company were already aware of the risks to pedestrians. This was due to previous workplace transport incidents in the yard. However, they ultimately failed to respond appropriately. They ignored the advice of their health and safety consultant and HSE, leaving workers exposed to risk.
The company pleaded guilty to breaching Regulation 4 (1) by virtue of Regulation 17 (1) of the Workplace (Health, Safety and Welfare) Regulations 1992. £150,000 in fines was payable by the company. They also had to pay costs of £7,454.20.
An Inspector from HSE spoke after the hearing. ‘Workplace transport activities are one of the biggest risks in the waste and recycling industry. This incident, and the resulting life changing injuries suffered, were avoidable and occurred as a result of a fundamental management failing on the part of the company and its directors’.
