Although most people know asbestos is a dangerous substance, many people do not realise how much of it is still present today.
Unfortunately, in this case, it seems that the company was aware of the risk, but did not manage it effectively.
Health & Safety Failings
A wood-working company and its director have been fined after an inspection by the Health & Safety Executive found a series of failings and risks associated with significant amounts of asbestos-containing materials within the premises.
Further to this, the court heard that an unexpected visit to the building took place from HSE. They found that the asbestos insulating board lining the building was found to be in very poor condition. Many panels had extensive damage. More over, the company was served an enforcement notice. This required the risks to be controlled and the asbestos materials to be removed by a licenced contractor.
Negligence or Ignorance?
An investigation took place. This found that the company had failed to ensure a suitable assessment had been carried out to find out if asbestos was present. This showed that the company had failed to manage the risks.
In addition to this, the company then fabricated documents to show that the asbestos materials would be removed by a licenced contractor.
In the end, the company pleaded guilty to a charge under Regulation 4 of the Control of Asbestos Regulations 2012. The company was fined £25,000 and the director of the company was sentenced to 12 months in prison, suspended for 18 months.
